PTI leader Asad Umar has submitted his reply to the Supreme Court in the ECP contempt case requesting the court to dismiss the election commission’s appeal.

The Supreme Court on Monday heard the ECP contempt case against PTI Chairman Imran Khan, Fawad Chaudhry, and Asad Umar.

Asad Umar submitted his written reply to the court.

In his reply, Umar requested the court to declare Section 10 of the Election Act unconstitutional and dismiss the Election Commission’s appeal.

The PTI leader said he had moved to the Sindh High Court against the show-cause notice issued by the ECP.

He said the ECP’s show-cause notice was illegal and unconstitutional.

He contended that Article 204 of the Constitution allows the higher judiciary to hold someone in contempt of court. But since the ECP is not a court, it could not exercise such a right, he added.

Umar said that the Section 10 of the Election Act is in contravention of the Constitution.

It may be noted that in January, the ECP had announced its decision to issue bailable arrest warrants for PTI chief Imran Khan and other senior party leaders, Asad Umar and Fawad Chaudhry, for failing to appear before the commission in contempt proceedings.
