    Supreme Court on Monday rejected the FIA report in Asghar Khan case directing the investigation agency to submit its fresh report within four weeks.

    “If someone denying to take money, so the court closes the case,” Justice Azmat Saeed asked.

    A two-member bench of Supreme Court, headed by Justice Azmat Saeed, is seized with Asghar Khan case relating to the implementation of its Oct 19, 2012 verdict.

    The court ordered Federal Investigation Agency (FIA) to submit a complete report.

    “It is the verdict of this court and we will implement it,” Justice Azmat Saeed said.

    Earlier, the FIA in a reply submitted in the Supreme Court pleaded again for winding up the case due to insufficient evidence.

    The investigation agency observed that how could a case be filed in any court due to ‘insufficient evidence’.

    The report said that the investigation about benami accounts and statements of key witnesses were recorded. To take the case forward and for further trial sufficient evidence could not be attained, FIA report said.

    It is not possible to initiate the case at any court due to insufficient evidence, the agency’s report said.

    Moreover, the Ministry of Defence submitted its report in Supreme Court with regard to the implementation of the Asghar Khan case verdict.

    In its report, the ministry of defence has stated to the apex court that the court of inquiry was entrusted with the responsibility to hold inquiry into the case.

    The defence ministry report said that six witnesses have already been examined and efforts were in hand to trace or call other witnesses as well.

    The report stated that all material witnesses would be examined by the court of inquiry accordingly and therefore all out efforts were being made to finalise the proceedings of the court of inquiry expeditiously as per rules and regulations.

    The apex court had in its order about April 02 hearing of the case said that the report submitted by the ministry of defence was unavailable in the court record and directed Director Legal of the ministry to re-submit the said report.

    The court order also said that some aspects of the Federal Investigation Agency (FIA) report are required an explanation.

    The apex court also ordered the FIA to submit a detailed report about the core accounts and other matters within 10 days.
